Licensed Practical Nurses Regulations

- The requirements and qualifications for a licence to practice as a
practical nurse are
-
completion of an application form that may be
obtained from the College;
-
proficiency in the English language that may be
shown by oral interview or the passing of the Test of English as a
Foreign Language with a minimum score of 550;
-
payment of the fees set by the
College;
-
within 5 years before the date of application,
successful completion of a basic practical nurse program of
education or its equivalent or a refresher program for practical
nurses, as approved by the College;
-
for applicants who have
successfully completed a basic practical nurse program of education
or its equivalent as approved by the College
-
within the province after May 15, 1984, or
-
outside the province,
Proof of successful completion of a licensing or registering
examination for practical nurses as approved by the College;
-
for applicants who are licensed practical nurses
or registered nursing assistants in a jurisdiction other than this
province before the date of application,
-
proof of that licensure or registration in
good standing or of eligibility for renewal of licensure or
registration in that jurisdiction,
-
satisfactory completion of an assessment and
evaluation of credentials and work history, and
-
proof that the applicant has worked as a
licensed practical nurse or registered nursing assistant for
-
at least 60 days in the 2 years
immediately preceding the licensing year for which the
application is submitted, or
-
at least 150 days in the 5 years
immediately preceding the licensing year for which the
application is submitted; and
-
the provision of evidence of good character
satisfactory to the College.

Not withstanding paragraph 3(1)(e), the Registrar of
Licensed Practical Nurses may issue a non-renewable temporary licence
for a period not exceeding 8 weeks following the first writing of the
licensing exam to an applicant who has met the other requirements of
this section respecting licensure or in other circumstances considered
appropriate by the College.

A person who meets the requirements of section 3 may be
granted a license to practise as a practical nurse and that licence shall be
effective from the date of issue until March 31, in a year.

The registrar may renew the licence of a practical
nurse who applies for renewal and pays the set fee if the practical
nurse has
-
within the previous 5 years, successfully
completed a basic practical nurse program of education or its
equivalent or a refresher program for practical nurses, as approved
by the College;
-
worked as a licensed practical nurse for at least
60 days in the 2 years immediately preceding the licensing year for
which renewal is sought;
-
worked as a licensed practical nurse for at least
150 days in the 5 years immediately preceding the licensing year for
which renewal is sought; or
-
acted as registrar of the
College within the
previous 5 years and has successfully completed a basic practical
nurse program of education or its equivalent as approved by the
College.

A licence shall expire on March 31 in a year, and
where a person satisfies the requirements of subsection (1) the
registrar may renew the licence and that licence shall
-
if renewed on April 1 in a year, be valid for a
year and shall expire on March 31 in a year; or
-
if renewed after April 1 in a year, be valid from
the date of renewal and shall expire on March 31 in a year.

The Registrar of Licensed Practical Nurses may remove
from the register the name of a licensed practical nurse who has not
paid in full the required registration fee including any arrears by
March 31 of the current registration year.

A practical nurse who has held a licence from the
College which has been cancelled as a result of disciplinary action by
the College may apply for reinstatement 5 years after the cancellation
with the approval of the College and may be reinstated subject to those
terms and conditions that the College may set.

A licensed practical nurse whose licence has been
suspended as a result of disciplinary action by the College may be
reinstated, subject to the payment of all appropriate fees upon the
expiration of the period of suspension and the satisfactory fulfilment
of any conditions of reinstatement which may have been set by the
College at the time of suspension of the licence.

A licensed practical nurse whose name has been
removed from the register for failure to meet the requirements of
section 5 may be reinstated

by submitting a completed application for
reinstatement form;
-
by paying a reinstatement fee set by the
College
and all outstanding registration fees, including any arrears; and
-
if required by the
College, by providing evidence
of good character satisfactory to the College.

A practical nurse whose licence in the province has
lapsed while he or she has maintained licensure or registration in
another jurisdiction may apply for reinstatement of licensure, and the
time worked in the other jurisdiction may count towards the time
requirement in section 5 provided that the time was worked as required
by that section.
